1. CONTRACTUAL OBLIGATIONS

1.1. When you place an order with us, you are making an offer to buy goods. Rwavhi will send you an e-mail to confirm that we have received your order.
1.2. Only once we have confirmed your order and received payment, will we ship your sculpture.
1.3. In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this, and the contract shall be considered nullified. Any payments processed shall be refunded if an order is cancelled due to any error by Rwavhi.
1.4. Ordering and payment errors made by the buyer will be the responsibility of the buyer, however we will do our due diligence in assisting to rectify the problem.
1.5. Images of sculptures on this website are for illustrative purposes only. Sculpture colouring and detail may vary slightly from the image shown on the website, and will not include any of the pictured mountings, stands or accessories unless otherwise stated.
1.6. Rwavhi has made every effort to display as accurately as possible the colours of our products that appear on this website. However, we cannot guarantee that your computer monitor’s display of any colour will accurately reflect the colour of the actual goods.
1.7. Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.
1.8. This contract shall be covered by South African law.
1.9. By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.

2. PLACING AN ORDER

2.1. Orders can be placed via the Rwavhi website by adding products to your virtual cart and following the checkout process. Orders can also be placed telephonically – our details can be found on the ‘CONTACT’ page.
2.2. All listed prices include shipping, packaging, professional crating and insurance.
2.3. You will be required to pay for the goods in full at the time of ordering.
2.4. You can pay for your order online by Visa, Mastercard, Direct Wire transfer/Electronic Funds Transfer (EFT) or PayPal.
2.5. Telephonic orders can be paid for by Electronic Funds transfer or PayPal only.
2.6. All prices quoted on our website are US $ Dollar and will be automatically converted to your cards’ currency using current exchange rates. We cannot be held accountable for additional charges applied by your financial institution.
2.7. Once your order has been confirmed, any changes may not be possible or may incur additional charges or delays.
2.8. Once your order is complete, you will receive further notification of dispatch and expected delivery.

3. DELIVERY PROCESS

3.1. Once we have received your order and subsequent payment, your sculpture will be properly packaged and crated to minimize the chance of damage in the delivery process.
3.2. Each sculpture will be dispatched with full insurance coverage up until the point of delivery.
3.3. Each order will normally be dispatched from our site within 5 – 14 working days, but can be subject to change without notice due to unforeseen circumstances or shipment of very large sculptures that require additional logistical arrangements.
3.4. Your order may arrive in more than one delivery, depending on the number of items purchased.
3.5. Sculptures ordered online can be delivered within South Africa, United Kingdom, United States, European Union, Australia and Canada, to addresses that are readily accessible by major delivery services.
3.6. If you are resident outside of the designated delivery zones, please contact us via phone or email as delivery may still be possible.
3.7. We will deliver the goods to the premises specified on your order. Each delivery will require a signature. Delivery times are typically between 9:00am and 6:00pm Monday-Friday. We will not accept responsibility for loss or damage if you instruct the delivery company to leave the goods unattended.
3.8. Larger sculpture deliveries will require someone at the delivery address to assist the driver in off-loading your order. If you are unable to assist, please notify us in advance.
3.9. Free shipping and delivery is subject to our discretion. We will evaluate your delivery address once items have been ordered and advise you if there are any additional charges.
3.10. If you have completed an order and payment online, but are deemed as ineligible for free delivery, we will notify you of any additional charges before dispatch, and you will have the option to cancel the order for a full refund.
3.11. After one failed delivery attempt (or if you are not at home for an agreed delivery), we will attempt one re-delivery and any additional costs incurred will be your responsibility.
3.12. If you wish to change the delivery address once the goods have been dispatched to you, we reserve the right to pass on any extra charges made by our carriers for redirecting your delivery.
3.13. Please check the goods upon delivery – any goods found to be missing or damaged at delivery should be brought to the attention of the driver. Your item will be fully insured for any in-transit damage or loss and evidence of such should be collected.
3.14. If the goods are lost or damaged in transit, please let us know immediately.
3.15. Deliveries are made to a ground floor entrance only and on the condition that there is reasonable access for the safe and prompt delivery of the goods. Please inform us about any special delivery requirements or conditions when you place your order.
3.16. Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. This could be due to events such as accidents, breakdowns, fire, flood, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers and shipping agents. We will attempt to rectify this as soon as possible however we will not be held responsible for any delay or inability to deliver as a result.

4. CANCELLATIONS & RETURNS

4.1. Orders may not be cancelled except by mutual agreement and having been confirmed in writing. Please contact us directly for cancellation requests.
4.2 Any sculpture which has been personalized or modified to your specification, shall not be eligible for cancellation.
4.3 Approved cancellations shall be processed as follows:
4.3.1. Cancellations made prior to dispatch will receive a full refund less any costs incurred by Rwavhi in processing the order and refund. These fees may include intermediary charges, packaging and insurance.
4.3.2. Dispatched orders will not be eligible for cancellation; however, goods may be returned.
4.4. Returns will be considered at Rwavhis discretion. Please contact us via email or phone to begin the return process. The buyer will be responsible for returning the sculpture to Rwavhi Johannesburg (or any other supplier that we specify, for the buyer’s convenience), properly packaged and insured.
4.5. Once the sculpture has been received and inspected, a refund shall be processed less any costs incurred by Rwavhi relating to the order in its entirety.
4.6. If you fail to take reasonable care of the goods before they are returned to us, resulting in any damage or deterioration, we will deduct an amount for any reduction in value.

5. INSURANCE & GUARANTEES

5.1. Goods shall be fully insured from dispatch up until delivery is inspected and accepted by the buyer. Claims for damage or loss in transit should be made within 2 business days of delivery or expected delivery.
5.2. If there is a problem with the goods, please notify us by email or in writing providing details of the problem, together with time-dated photographic evidence.
5.3. It will be at our discretion at Rwavhi to decide whether faulty goods are eligible for a refund or replacement.
5.4. The cost of returning goods to us is your responsibility, however upon inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. Should they be found not to be faulty, they will be treated as a normal return.
5.5. There is no guarantee on the lasting colouration and surface of any sculpture which is exposed to natural elements. Sculptures should be cleaned and cared for in accordance with our care and maintenance instructions.
5.6. Each sculpture’s life expectancy is subject to its own material and environment, Rwavhi will provide you with a care sheet on maintenance and protection but will not take responsibility and not provide any refund for corrosion or damage after the buyer takes delivery of the sculpture.
5.7. All photos provided on the website are originals of each unique sculpture and aim to provide an accurate representation, however we are unable to guarantee an exact color match to your computer monitor.

6. LIABILITY

6.1. We do not accept liability for any personal injury or disturbance from any sculpture or installation.
6.2. We do not accept liability for any consequential loss of profit or indirect losses. You should therefore not book installation with other firms for the goods until you have received them and inspected them.
